Allgemeine Geschäftsbedingungen (AGB) der Derma Academy Germany
für Bildungsdienstleistungen im Bereich der ästhetischen Dermatologie und medizinischen Kosmetik

- 1 Geltungsbereich und Vertragsparteien
(1) Diese Allgemeinen Geschäftsbedingungen (nachfolgend “AGB”) gelten für sämtliche Verträge zwischen der Derma Academy (nachfolgend “Anbieterin”) und dem Kunden (nachfolgend “Teilnehmer” oder “Auftraggeber”) über Schulungs-, Fortbildungs- und Bildungsdienstleistungen, unabhängig davon, ob diese als Präsenzveranstaltung, Online-Seminar, Webinar oder in hybrider Form erbracht werden. Die Derma Academy wird vertreten durch die Derma Contour UG, Hausinger Strasse 6, 40764 Langenfeld NRW – nachfolgend “Anbieterin” genannt.
(2) Teilnehmer im Sinne dieser AGB können sowohl Unternehmer im Sinne des § 14 BGB (nachfolgend “Geschäftskunden” oder “B2B”) als auch Verbraucher im Sinne des § 13 BGB (nachfolgend “Privatkunden” oder “B2C”) sein. Soweit einzelne Bestimmungen dieser AGB nur für Geschäftskunden oder nur für Verbraucher gelten, wird hierauf ausdrücklich hingewiesen.
(3) Abweichende, entgegenstehende oder ergänzende Allgemeine Geschäftsbedingungen des Teilnehmers werden nur dann Vertragsbestandteil, wenn die Anbieterin ihrer Geltung ausdrücklich und schriftlich zugestimmt hat. Dieses Zustimmungserfordernis gilt in jedem Fall, auch wenn die Anbieterin in Kenntnis der AGB des Teilnehmers die Leistung vorbehaltlos erbringt.
(4) Im Einzelfall getroffene, individuelle Vereinbarungen mit dem Teilnehmer (einschließlich Nebenabreden, Ergänzungen und Änderungen) haben in jedem Fall Vorrang vor diesen AGB. Für den Inhalt derartiger Vereinbarungen ist ein schriftlicher Vertrag bzw. die schriftliche Bestätigung der Anbieterin maßgebend.
- 2 Vertragsgegenstand und Leistungsbeschreibung
(1) Die Anbieterin erbringt Bildungsdienstleistungen im Bereich der ästhetischen Dermatologie und medizinischen Kosmetik, insbesondere:
- Fortbildungen und Schulungen zu Laseranwendungen (Haarentfernung, Hautverjüngung)
- Schulungen zu Radiofrequenz-Straffung (monopolar und bipolar)
- Kombinationsprotokolle (Laser + MLD + RF)
- Fachkundenachweis-Vorbereitung gemäß NiSV (Non-Ionizing Radiation Protection Ordinance)
- Weiterbildungen im Bereich der ästhetischen Konturierung und Fettreduktion
- Inhouse-Schulungen und individuelle Trainings
(2) Die konkreten Leistungsinhalte, Schulungsumfänge, Termine und Preise ergeben sich aus der jeweiligen Leistungsbeschreibung auf der Website der Anbieterin, dem individuellen Angebot oder der Auftragsbestätigung.
(3) Die Anbieterin behält sich vor, Referenten, Dozenten oder einzelne Schulungsinhalte bei Bedarf zu ändern, soweit das Schulungsziel hierdurch nicht wesentlich beeinträchtigt wird und die Änderung für den Teilnehmer zumutbar ist.
(4) Die Schulungen orientieren sich an den jeweils geltenden gesetzlichen Bestimmungen, insbesondere der NiSV (Verordnung zum Schutz vor schädlichen Wirkungen nichtionisierender Strahlung bei der Anwendung am Menschen) sowie den berufsgenossenschaftlichen Vorschriften. Die ausgestellten Teilnahmebescheinigungen dokumentieren die erfolgreiche Teilnahme an der jeweiligen Schulung.
- 3 Vertragsschluss
(1) Die Darstellung der Schulungen auf der Website der Anbieterin stellt kein rechtlich bindendes Angebot, sondern eine unverbindliche Aufforderung zur Abgabe eines Angebots (invitatio ad offerendum) dar.
(2) Der Teilnehmer gibt durch die Buchung über die Website, per E-Mail, telefonisch oder über ein Kontaktformular ein verbindliches Angebot zum Abschluss eines Schulungsvertrages ab.
(3) Der Vertrag kommt zustande durch:
- schriftliche Anmeldebestätigung der Anbieterin, oder
- Übersendung einer Rechnung, oder
- bei Online-Kursen: Übermittlung der Zugangsdaten zur Lernplattform
(4) Die Anbieterin ist berechtigt, Anmeldungen ohne Angabe von Gründen abzulehnen, insbesondere wenn:
- die Schulung bereits ausgebucht ist,
- der Teilnehmer die erforderlichen Voraussetzungen für die Schulung nicht erfüllt,
- gegen den Teilnehmer offene Forderungen aus früheren Geschäftsbeziehungen bestehen,
- in der Person des Teilnehmers ein wichtiger Grund für die Verweigerung der Teilnahme vorliegt (z.B. fehlende berufliche Qualifikation für spezielle Fortbildungen).
(5) Mit der Anmeldung erkennt der Teilnehmer diese AGB an. Die AGB werden dem Teilnehmer spätestens mit der Anmeldebestätigung in Textform übermittelt.
- 4 Preise, Zahlungsbedingungen und Fälligkeit
(1) Es gelten die zum Zeitpunkt der Buchung auf der Website der Anbieterin angegebenen oder im individuellen Angebot genannten Preise. Alle Preise verstehen sich, sofern nicht anders angegeben, zuzüglich der gesetzlichen Mehrwertsteuer.
(2) Die Rechnungsstellung erfolgt elektronisch per E-Mail im PDF-Format. Der Teilnehmer erklärt sich mit dem elektronischen Rechnungsversand einverstanden.
(3) Der Rechnungsbetrag ist innerhalb von 14 Tagen nach Rechnungsdatum ohne Abzug zur Zahlung fällig, sofern nicht individuell etwas anderes vereinbart wurde.
(4) Bei Online-Kursen, die über den Online-Shop der Anbieterin gebucht werden, ist die Zahlung vor Freischaltung des Kurszugangs zu leisten. Der Zugang wird unmittelbar nach Zahlungseingang freigeschaltet.
(5) Die Aufrechnung mit Gegenansprüchen des Teilnehmers oder die Zurückbehaltung von Zahlungen wegen solcher Ansprüche ist nur zulässig, wenn die Gegenansprüche unbestritten oder rechtskräftig festgestellt sind.
- 5 Zahlungsverzug
(1) Leistet der Teilnehmer bei Fälligkeit nicht, kommt er ohne weitere Mahnung in Verzug, wenn in der Rechnung ein bestimmter Kalendertag als Fälligkeitstermin angegeben ist (§ 286 Abs. 2 Nr. 1 BGB).
(2) Im Falle des Zahlungsverzugs ist die Anbieterin berechtigt, Verzugszinsen zu verlangen:
- Bei Verbrauchern (B2C): 5 Prozentpunkte über dem jeweiligen Basiszinssatz der Europäischen Zentralbank (§ 288 Abs. 1 BGB)
- Bei Unternehmern (B2B): 9 Prozentpunkte über dem jeweiligen Basiszinssatz (§ 288 Abs. 2 BGB) sowie eine Pauschale von 40,00 EUR für Beitreibungskosten (§ 288 Abs. 5 BGB)
(3) Bei Zahlungsverzug ist die Anbieterin berechtigt:
- die Übersendung von Teilnahmebescheinigungen und Zertifikaten bis zur vollständigen Zahlung zurückzuhalten,
- den Zugang zu Online-Lernplattformen zu sperren,
- weitere Leistungen zu verweigern, bis alle offenen Forderungen beglichen sind.
- 6 Rücktritt und Stornierung durch den Teilnehmer
- A) Präsenzschulungen und Hybrid-Seminare
(1) Eine Stornierung durch den Teilnehmer muss schriftlich (per E-Mail, Fax oder Brief) erfolgen. Maßgeblich für die Fristberechnung ist der Eingang der Stornierungserklärung bei der Anbieterin.
(2) Bei Stornierung werden folgende Stornogebühren erhoben:

2 – 4 Wochen vor Veranstaltungsbeginn | 30 % der Seminargebühr |
1 – 2 Wochen vor Veranstaltungsbeginn | 50 % der Seminargebühr |
Weniger als 1 Woche vor Veranstaltungsbeginn bzw. bei Nichtteilnahme | 100 % der Seminargebühr |
(3) Der Teilnehmer kann anstelle der Stornierung kostenfrei einen geeigneten Ersatzteilnehmer benennen, sofern dieser die Teilnahmevoraussetzungen erfüllt und die Anbieterin rechtzeitig (mindestens 3 Werktage vor Veranstaltungsbeginn) schriftlich informiert wird.
(4) Der Teilnehmer kann nachweisen, dass der Anbieterin durch die Stornierung kein oder ein geringerer Schaden entstanden ist. In diesem Fall reduziert sich die Stornogebühr entsprechend.
- B) E-Learning-Kurse und Online-Seminare
(5) Bei E-Learning-Kursen und Online-Seminaren ist eine Stornierung nach Übermittlung der Zugangsdaten oder Freischaltung des Kurszugangs ausgeschlossen. Die vollständige Kursgebühr ist in diesem Fall geschuldet.
(6) Eine Stornierung vor Übermittlung der Zugangsdaten ist kostenfrei möglich.
- 7 Rücktritt durch die Anbieterin / Veranstaltungsausfall
(1) Die Anbieterin ist berechtigt, vor Beginn der Veranstaltung vom Vertrag zurückzutreten, wenn:
- die im Leistungsangebot festgelegte Mindestteilnehmerzahl nicht erreicht wird,
- aus anderen wichtigen Gründen (höhere Gewalt, plötzliche Erkrankung des Referenten, behördliche Anordnungen, pandemiebedingte Einschränkungen),
(2) Bei Absage einer Veranstaltung informiert die Anbieterin den Teilnehmer unverzüglich. Bereits gezahlte Gebühren werden erstattet.
(3) Die Anbieterin ist berechtigt, die Veranstaltung zu einem anderen Termin und/oder an einem anderen Ort durchzuführen, wenn dies für den Teilnehmer zumutbar ist. In diesem Fall hat der Teilnehmer kein Recht auf Erstattung der Seminargebühr, sofern der Ersatztermin zumutbar ist.
(4) Bei Ausfall oder Terminverschiebung übernimmt die Anbieterin keine Haftung für Reise- und Übernachtungskosten oder sonstige Auslagen des Teilnehmers.
- 8 Widerrufsrecht für Verbraucher
(1) Verbrauchern im Sinne des § 13 BGB steht bei Fernabsatzverträgen ein gesetzliches Widerrufsrecht nach § 355 BGB zu.
(2) Das Widerrufsrecht beträgt 14 Tage und beginnt mit Vertragsschluss.
(3) Wichtige Ausnahmen vom Widerrufsrecht:
Das Widerrufsrecht besteht nicht bei Verträgen zur Erbringung von Dienstleistungen im Zusammenhang mit Freizeitbetätigungen, wenn der Vertrag für die Erbringung einen spezifischen Termin oder Zeitraum vorsieht (§ 312g Abs. 2 Nr. 9 BGB).
Bei Fernunterrichtsverträgen gemäß FernUSG gelten besondere Widerrufs- und Kündigungsrechte.
(4) Die Anbieterin wird dem Teilnehmer mit der Anmeldebestätigung eine gesonderte Widerrufsbelehrung in Textform zukommen lassen.
- 9 Urheberrecht und Nutzungsrechte
(1) Der Anbieterin verbleiben alle urheberrechtlichen Nutzungsrechte und alle Verwertungsrechte an den im Rahmen einer Schulung überlassenen Schulungsunterlagen, Präsentationen, Skripten, Handouts, Powerpoint-Folien, Videos und sonstigen Materialien.
(2) Die Unterlagen dürfen nicht zur Weitergabe an Dritte vervielfältigt werden. Ausgenommen ist die Vervielfältigung zum Zwecke der Datensicherung oder für den eigenen Gebrauch.
(3) Die im Rahmen von Online-Seminaren/Webinaren zur Verfügung gestellten Aufzeichnungen und Mitschnitte dürfen weder komplett noch in Ausschnitten an Dritte weitergegeben oder vervielfältigt werden. Ein Download der Aufzeichnungen ist untersagt. Eigene Aufnahmen während des Online-Seminars sind nicht gestattet.
(4) Die Schulungsinhalte sind urheberrechtlich geschützt. Jede Form der gewerblichen Nutzung oder Verwertung bedarf der ausdrücklichen schriftlichen Zustimmung der Anbieterin.
- 10 Pflichten des Teilnehmers
(1) Der Teilnehmer ist verpflichtet, der Anbieterin alle Daten und Informationen zur Verfügung zu stellen, die zur erfolgreichen und vollständigen Erbringung der Leistung notwendig sind.
(2) Bei Präsenzveranstaltungen ist der Teilnehmer verpflichtet:
- die Sicherheitsvorschriften und Unfallverhütungsbestimmungen der Veranstaltungsräumlichkeiten zu beachten,
- mitgebrachte Geräte (z.B. Lasergeräte) in einwandfreiem Zustand zu halten,
- die Nutzung von Schutzbrillen und anderen Sicherheitsvorkehrungen zu befolgen,
(3) Bei Online-Seminaren ist der Teilnehmer verpflichtet:
- für eine stabile Internetverbindung zu sorgen,
- die Zugangsdaten geheim zu halten und nicht an Dritte weiterzugeben,
- die technischen Mindestanforderungen für die Teilnahme zu erfüllen.
- 11 Haftung
(1) Die Anbieterin haftet für Schäden aus der Verletzung des Lebens, des Körpers oder der Gesundheit sowie für Schäden, die auf Vorsatz oder grober Fahrlässigkeit der Anbieterin oder ihrer gesetzlichen Vertreter oder Erfüllungsgehilfen beruhen, nach den gesetzlichen Vorschriften.
(2) Bei leicht fahrlässiger Verletzung wesentlicher Vertragspflichten (Kardinalpflichten) ist die Haftung der Anbieterin auf den vertragstypischen, vorhersehbaren Schaden begrenzt.
(3) Die Anbieterin übernimmt keine Haftung für einen mit der Veranstaltung beabsichtigten Erfolg (z.B. Bestehen von Prüfungen, Erwerb bestimmter Qualifikationen) oder die berufliche Eignung des Teilnehmers.
(4) Für Beratungsfehler oder sonstige Leistungsstörungen von Dritten (z.B. externen Referenten) haftet die Anbieterin nicht, es sei denn, der Mangel beruht auf einem Verschulden der Anbieterin.
(5) Sofern Bildungsveranstaltungen in den Räumlichkeiten des Teilnehmers stattfinden, ist dieser für die Ausstattung der Räume und die Erfüllung der Sicherheitsvorschriften und Unfallverhütungsbestimmungen verantwortlich.
(6) Die Haftung für mittelbare Schäden gegenüber einem Unternehmer ist auf das 10-fache des Rechnungsbetrages begrenzt.
(7) Die Vorschriften des Produkthaftungsgesetzes bleiben unberührt.
- 12 Datenschutz
(1) Die Anbieterin verarbeitet personenbezogene Daten der Teilnehmer im Rahmen der gesetzlichen Bestimmungen der Datenschutz-Grundverordnung (DSGVO) und des Bundesdatenschutzgesetzes (BDSG).
(2) Die Daten der Teilnehmer werden für folgende Zwecke verarbeitet:
- Abwicklung des Vertragsverhältnisses
- Rechnungsstellung und Zahlungsabwicklung
- Kommunikation im Zusammenhang mit der Veranstaltung
- Ausstellung von Teilnahmebescheinigungen
- Information über weitere Veranstaltungen der Anbieterin (mit Einwilligung)
(3) Eine Weitergabe der Daten an Dritte erfolgt nur, soweit dies zur Durchführung der Veranstaltung erforderlich ist (z.B. an externe Referenten, Dienstleister für die technische Durchführung von Online-Veranstaltungen).
(4) Die vollständige Datenschutzerklärung ist auf der Website der Anbieterin einsehbar und wird dem Teilnehmer auf Wunsch zugesandt.
- 13 Schlussbestimmungen
(1) Es gilt das Recht der Bundesrepublik Deutschland unter Ausschluss des UN-Kaufrechts (CISG). Bei Verbrauchern gilt diese Rechtswahl nur, soweit der gewährte Schutz nicht durch zwingende Bestimmungen des Rechts des Staates, in dem der Verbraucher seinen gewöhnlichen Aufenthalt hat, eingeschränkt wird.
(2) Ist der Teilnehmer Kaufmann, eine juristische Person des öffentlichen Rechts oder ein öffentlich-rechtliches Sondervermögen, ist ausschließlicher Gerichtsstand für alle Streitigkeiten aus diesem Vertrag der Sitz der Anbieterin.
(3) Sollte eine Bestimmung dieser AGB unwirksam oder undurchführbar sein oder werden, berührt dies die Wirksamkeit der übrigen Bestimmungen nicht. An die Stelle der unwirksamen oder undurchführbaren Bestimmung tritt eine wirksame und durchführbare Regelung, die dem wirtschaftlichen Zweck der unwirksamen Bestimmung möglichst nahekommt.
(4) Änderungen und Ergänzungen dieser AGB bedürfen der Schriftform.

General Terms and Conditions (GTC) of Derma Academy
for Educational Services in the Field of Aesthetic Dermatology and Medical Cosmetics
Status: December 2025
- 1 Scope and Contractual Parties
(1) These General Terms and Conditions (hereinafter referred to as “GTC”) apply to all contracts between Derma Academy (hereinafter referred to as the “Provider”) and the customer (hereinafter referred to as the “Participant” or “Client”) regarding training, further education, and educational services, regardless of whether these are provided as in-person events, online seminars, webinars, or in hybrid form. Derma Academy is represented by Derma Contour UG, Hausinger Strasse 6, 40764 Langenfeld Germany – hereinafter referred to as the “Provider”.
(2) Participants within the meaning of these GTC may be both entrepreneurs within the meaning of § 14 of the German Civil Code (BGB) (hereinafter referred to as “Business Customers” or “B2B”) and consumers within the meaning of § 13 BGB (hereinafter referred to as “Private Customers” or “B2C”). Where individual provisions of these GTC apply only to business customers or only to consumers, this will be expressly noted.
(3) Deviating, conflicting, or supplementary general terms and conditions of the Participant shall only become part of the contract if the Provider expressly agrees to their validity in writing. This requirement of consent applies in any case, even if the Provider renders the service without reservation while being aware of the Participant’s GTC.
(4) Individual agreements made with the Participant in individual cases (including ancillary agreements, supplements, and amendments) shall in any case take precedence over these GTC. The content of such agreements shall be governed by a written contract or the written confirmation of the Provider.
- 2 Subject Matter of the Contract and Description of Services
(1) The Provider provides educational services in the field of aesthetic dermatology and medical cosmetics, in particular:
- Advanced training and courses on laser applications (hair removal, skin rejuvenation)
- Training on radiofrequency tightening (monopolar and bipolar)
- Combination protocols (laser + MLD + RF)
- Preparation for the specialist certificate according to NiSV (Non-Ionizing Radiation Protection Ordinance)
- Continuing education in the field of aesthetic contouring and fat reduction
- In-house training and individual coaching
(2) The specific service contents, course scopes, dates, and prices are set out in the respective service description on the Provider’s website, the individual offer, or the order confirmation.
(3) The Provider reserves the right to change lecturers, instructors, or individual course contents, if necessary, provided that the course objective is not substantially impaired and the change is reasonable for the Participant.
(4) The courses comply with the applicable legal provisions, in particular the NiSV (Ordinance on Protection against Harmful Effects of Non-Ionizing Radiation when Applied to Humans) as well as the accident prevention regulations of the professional associations. The certificates of attendance issued document the successful participation in the respective course.
- 3 Conclusion of Contract
(1) The presentation of courses on the Provider’s website does not constitute a legally binding offer, but rather a non-binding invitation to submit an offer (invitatio ad offerendum).
(2) The Participant submits a binding offer to conclude a course contract by booking via the website, by email, by telephone, or via a contact form.
(3) The contract is concluded upon:
- written confirmation of registration by the Provider, or
- sending of an invoice, or
- for online courses: provision of access data to the learning platform
(4) The Provider is entitled to reject registrations without giving reasons, in particular if:
- the course is already fully booked,
- the Participant does not meet the required prerequisites for the course,
- there are outstanding claims against the Participant from previous business relationships,
- there is an important reason in the person of the Participant for refusing participation (e.g., lack of professional qualification for specialized training).
(5) By registering, the Participant acknowledges these GTC. The GTC will be sent to the Participant in text form at the latest with the registration confirmation.
- 4 Prices, Payment Terms, and Due Date
(1) The prices stated on the Provider’s website at the time of booking or in the individual offer shall apply. All prices are, unless otherwise stated, exclusive of the statutory value-added tax.
(2) Invoicing is done electronically via email in PDF format. The Participant agrees to electronic invoice dispatch.
(3) The invoice amount is due within 14 days of the invoice date without deduction, unless otherwise individually agreed.
(4) For online courses booked through the Provider’s online shop, payment must be made before the course access is activated. Access will be activated immediately after receipt of payment.
(5) The offsetting of counterclaims by the Participant or the retention of payments due to such claims is only permitted if the counterclaims are undisputed or have been legally established.
- 5 Default of Payment
(1) If the Participant fails to pay when due, they shall be in default without the need for a reminder if a specific calendar date is stated as the due date on the invoice (§ 286 Para. 2 No. 1 BGB).
(2) In the event of default of payment, the Provider is entitled to demand default interest:
- For consumers (B2C): 5 percentage points above the respective base interest rate of the European Central Bank (§ 288 Para. 1 BGB)
- For entrepreneurs (B2B): 9 percentage points above the respective base interest rate (§ 288 Para. 2 BGB) as well as a flat fee of €40.00 for collection costs (§ 288 Para. 5 BGB)
(3) In the event of default of payment, the Provider is entitled to:
- withhold the dispatch of certificates of attendance and certificates until full payment is made,
- block access to online learning platforms,
- refuse further services until all outstanding claims are settled.
- 6 Cancellation and Withdrawal by the Participant
- A) In-Person Courses and Hybrid Seminars
(1) Cancellation by the Participant must be made in writing (by email, fax, or letter). The receipt of the cancellation declaration by the Provider is decisive for the deadline.
(2) In the event of cancellation, the following cancellation fees shall be charged:

1 – 2 weeks before the start of the event | 50% of the seminar fee |
Less than 1 week before the start of the event or in case of non-participation | 100% of the seminar fee |
(3) Instead of cancelling, the Participant may nominate a suitable substitute participant free of charge, provided that this person meets the participation requirements and the Provider is informed in writing in good time (at least 3 working days before the start of the event).
(4) The Participant may prove that no loss or a lesser loss has been incurred by the Provider due to the cancellation. In this case, the cancellation fee shall be reduced accordingly.
- B) E-Learning Courses and Online Seminars
(5) For e-learning courses and online seminars, cancellation after the access data has been sent or the course access has been activated is excluded. The full course fee is due in this case.
(6) Cancellation before the access data has been sent is possible free of charge.
- 7 Withdrawal by the Provider / Cancellation of Events
(1) The Provider is entitled to withdraw from the contract before the start of the event if:
- the minimum number of participants specified in the service offer is not reached,
- for other important reasons (force majeure, sudden illness of the lecturer, official orders, pandemic-related restrictions).
(2) In the event of cancellation of an event, the Provider shall inform the Participant immediately. Fees already paid will be refunded.
(3) The Provider is entitled to hold the event on a different date and/or at a different location if this is reasonable for the Participant. In this case, the Participant has no right to a refund of the seminar fee, provided that the alternative date is reasonable.
(4) In the event of cancellation or rescheduling, the Provider shall not be liable for travel and accommodation costs or other expenses incurred by the Participant.
- 8 Right of Withdrawal for Consumers
(1) Consumers within the meaning of § 13 BGB have a statutory right of withdrawal for distance contracts in accordance with § 355 BGB.
(2) The right of withdrawal is 14 days and begins upon conclusion of the contract.
(3) Important exceptions to the right of withdrawal:
The right of withdrawal does not apply to contracts for the provision of services in connection with leisure activities if the contract provides for a specific date or period for the provision (§ 312g Para. 2 No. 9 BGB).
For distance learning contracts in accordance with the FernUSG (Distance Learning Protection Act), special cancellation and termination rights apply.
(4) The Provider will send the Participant a separate cancellation policy in text form together with the registration confirmation.
- 9 Copyright and Usage Rights
(1) All copyright and exploitation rights to the course materials, presentations, scripts, handouts, PowerPoint slides, videos, and other materials provided as part of a course shall remain with the Provider.
(2) The materials may not be reproduced for distribution to third parties. Excepted from this is reproduction for the purpose of data backup or for personal use.
(3) The recordings and footage provided as part of online seminars/webinars may not be passed on to third parties or reproduced, either in whole or in part. Downloading the recordings is prohibited. Making one’s own recordings during the online seminar is not permitted.
(4) The course contents are protected by copyright. Any form of commercial use or exploitation requires the express written consent of the Provider.
- 10 Obligations of the Participant
(1) The Participant is obliged to provide the Provider with all data and information necessary for the successful and complete provision of the service.
(2) For in-person events, the Participant is obliged to:
- comply with the safety regulations and accident prevention rules of the event premises,
- keep any equipment brought along (e.g., laser devices) in perfect condition,
- follow the use of protective goggles and other safety measures.
(3) For online seminars, the Participant is obliged to:
- ensure a stable internet connection,
- keep the access data confidential and not pass it on to third parties,
- meet the technical minimum requirements for participation.
- 11 Limitation of Liability
(1) The Provider shall be liable for damages resulting from injury to life, body, or health, as well as for damages based on intent or gross negligence on the part of the Provider or its legal representatives or vicarious agents, in accordance with the statutory provisions.
(2) In the event of slight negligence in the breach of essential contractual obligations (cardinal duties), the Provider’s liability shall be limited to the contract-typical, foreseeable damage.
(3) The Provider shall not be liable for any success intended with the event (e.g., passing examinations, acquiring specific qualifications) or the professional suitability of the Participant.
(4) The Provider shall not be liable for consulting errors or other service disruptions by third parties (e.g., external lecturers), unless the defect is based on the Provider’s fault.
(5) If educational events take place on the Participant’s premises, the Participant is responsible for the equipment of the rooms and compliance with safety regulations and accident prevention rules.
(6) Liability for indirect damages vis-à-vis an entrepreneur is limited to 10 times the invoice amount.
(7) The provisions of the Product Liability Act remain unaffected.
- 12 Data Protection
(1) The Provider processes the Participants’ personal data in accordance with the statutory provisions of the General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (BDSG).
(2) The Participants’ data will be processed for the following purposes:
- execution of the contractual relationship
- invoicing and payment processing
- communication in connection with the event
- issuance of certificates of attendance
- information about further events of the Provider (with consent)
(3) Data will only be passed on to third parties insofar as this is necessary for the execution of the event (e.g., to external lecturers, service providers for the technical execution of online events).
(4) The complete data protection declaration is available on the Provider’s website and will be sent to the Participant upon request.
- 13 Final Provisions
(1) The law of the Federal Republic of Germany shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law shall only apply insofar as the protection granted is not restricted by mandatory provisions of the law of the country in which the consumer has their habitual residence.
(2) If the Participant is a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from this contract shall be the Provider’s registered office.
(3) Should any provision of these GTC be or become invalid or unenforceable, this shall not affect the validity of the remaining provisions. The invalid or unenforceable provision shall be replaced by a valid and enforceable provision that comes as close as possible to the economic purpose of the invalid provision.
(4) Amendments and supplements to these GTC shall be in writing.
